Terms of Service

1. Parties
These Terms of Service ("Terms") govern the use of the WhatsApp Sales OS platform ("Service") provided by ATENCIA CANOLES MIGUEL ALBERTO, trading as WithCoffeeAI, located in Itagüí, Antioquia, Colombia ("Provider"). By using the Service, you ("Merchant") agree to these Terms.
2. Service description
WithCoffeeAI provides a multi-tenant SaaS platform that integrates with the WhatsApp Business API to manage sales conversations, product catalogs, orders, payments, and AI-powered sales automation. The Service is provided on a subscription basis.
3. Account and access
- You must be at least 18 years old and have legal authority to bind your business to these Terms.
- You are responsible for maintaining the security of your account credentials.
- One account corresponds to one business entity (tenant). Sharing accounts across different legal entities is not permitted.
- You must provide accurate and complete information during registration.
4. WhatsApp Business API and Meta policies
Use of the Service is subject to Meta's WhatsApp Business API Terms of Service and usage policies. You agree to:
- Only send messages to users who have opted in to receive communications
- Comply with all applicable messaging regulations and anti-spam laws
- Not use the platform for prohibited content categories defined by Meta
- Maintain an approved Meta Business account in good standing
5. Payments and billing
Subscription fees, applicable service fees, and billing terms are specified in the pricing page at app.withcoffeeai.com. Fees are charged in Colombian Pesos (COP). Failure to pay may result in service suspension.
6. Acceptable use
You may not use the Service to:
- Send spam or unsolicited messages
- Engage in fraudulent, deceptive, or misleading practices
- Violate any applicable law or regulation
- Infringe on third-party intellectual property rights
- Attempt to reverse engineer or circumvent platform security
7. Data ownership
You retain ownership of all data you input into the Service, including customer data, product catalog, and conversation history. You grant WithCoffeeAI a limited license to process this data solely to provide the Service.
8. Service availability and SLA
WithCoffeeAI targets 99.5% monthly uptime for the platform. Planned maintenance will be communicated 24 hours in advance. We are not responsible for downtime caused by third-party services, including Meta's WhatsApp Business API.
9. Limitation of liability
WithCoffeeAI's maximum liability for any claim arising from these Terms shall not exceed the total fees paid by the Merchant in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or lost data.
10. Termination
Either party may terminate the agreement with 30 days' written notice. WithCoffeeAI may terminate immediately for material breach of these Terms or Meta's policies. Upon termination, you may request an export of your data within 30 days.
11. Governing law
These Terms are governed by the laws of the Republic of Colombia. Disputes shall be resolved before the competent courts of Itagüí, Antioquia, Colombia.
